a. According to Regiment ByLaws in effect, operations performed by or representing the Regiment and units thereof must occur with Command Committee review or authorization per paragraph 3.1.1.
b. ByLaws further stipulate in paragraph 3.1.2 that BN command decisions may be made at the battalion level, however, operations that occur must be in line with ByLaws and values representing the 2nd Regiment, and therefore must have Regimental Command Committee approval.
c. Multiple operations have occurred that did not have a command committee review. Further, information has been provided either inadvertently or by design to cloud the true purpose of those operations. Such operations may bring into question the purpose of the militia, and/or the intents of the entire Regiment and have occurred on multiple occasions.
d. These operations can be considered or potentially classified as militant, inciteful, and even potentially unlawful. Which could be detrimental to the 2nd Infantry Regiment and its members.
e. As such, the commanders of 1st Battalion, including A, G, and H companies, and 3rd Battalion, B, F, and I companies serving as command committees for those Battalions, have determined, based on cited events, to remove, from the 2nd Infantry Regiment, C, D, E companies in order to distance themselves from potential legal liability in light of the continued militant activities of other units within the Regiment.
f. Prior to the decision to withdraw from the Regiment, efforts were made to mitigate these behaviors and actions with no positive results as the units continued on an aggressive path of training and intent.
f. Members within the cited battalions who wish to remain in the 2nd Infantry Regiment will be removed from unit roster and allowed to pursue continued membership in 2nd Infantry Regiment.
g. All members of previously cited units will retain rank, status and position within a new designated unit to be known hereby as the California State Volunteers, and will continue to espouse the values and ideals stated in the former 2nd Infantry Regiment ByLaws and do incorporate those ByLaws as our regulations.

CALIFORNIA STATE MILITIA, 2ND REGIMENT ADDRESSES FALSE ACCUSATIONS
YUCCA VALLEY, CA, January 31, 2016 for immediate dissemination to all outlets.
The 2nd Regiment of the California State Militia is addressing libelous and slanderous accusations by other units of the California State Militia. These other units are providing knowingly false information through electronic and possibly verbal methods in order to denigrate the image and/or legal standing of the 2nd Regiment.
Accusations and Assertions:
1. That our Regiment is not a member of the California State Militia.
2. That our organization is counterfeit and otherwise unlawful or unsanctioned.
3. That members of our organization went to Oregon in support of militia members occupying the federal building.
4. That an entity lays claim to the trademark of the California State Militia patch design and all iterations.
Response:
1. Per California Military and Veterans Code §120 to §130, our organization is a part of that class
2. Per Definition of Unorganized Militia per California Military and Veterans Code §121
The unorganized militia consists of all persons liable to service in the militia, but not members of the National Guard, the State Military Reserve, or the Naval Militia.
3. No member of the California State Militia, 2nd Regiment, Alpha Company traveled under ANY sanction from the chain of command to stand with the Oregon militia members.
3a. Furthermore, the individual that was noted up in Oregon was in fact a California citizen from the northern area which is not an area of operations for the 2nd Regiment.
4. Per trademark and copyright searches and confirmation from one of the original designers of the “CSM” patches, James Haggenson who explicitly states “Just use the designs, no one has a copy right of either patch, they are just a combination of other designs put together by several of us.”
For clarification: The 2nd Regiment of the California State Militia is a legal, unorganized civilian militia as authorized by the U.S. Constitution, Bill of Rights and the California State Constitution
Details and screenshots of the 2nd Regiment’s claim of libel are available by contacting us on our website: http://www.californiastatemilitia.org
